Welcome to Papillon Jewelry LLC ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website located at papillonjewels.com, online booking services, and all in-person permanent jewelry services and products provided at our physical studio locations and pop-up events.

By accessing our website, booking an appointment, purchasing a product, or receiving in-person services, you agree to be bound by these Terms. If you do not agree, please do not use our services or visit our studio.

1. Digital & Website Use Terms

  • 1.1 Intellectual Property: All content on our website, including text, logos, designs, graphics, photographs, and branding, is the property of Papillon Jewelry LLC and protected by intellectual property laws. You may not copy, reproduce, or distribute any content without prior written permission.

  • 1.2 Online Booking & Appointments: Online appointments are managed via third-party scheduling platforms (e.g., Acuity Scheduling). By booking, you agree to provide accurate contact and payment information.

  • 1.3 Cancellations & Late Policy: Appointments must be canceled or rescheduled at least 24 hours in advance. Booking deposits or fees may be non-refundable in the event of late cancellations or no-shows.

2. In-Studio & Physical Service Terms (Permanent Jewelry)

  • 2.1 Nature of Permanent Jewelry: Permanent jewelry consists of custom-sized chains welded directly around the wrist, ankle, neck, or finger without a traditional clasp using a specialized micro-welding process.

  • 2.2 Assumption of Risk & Safety:

    • Micro-welding involves precise heat and light bursts. You agree to follow all safety instructions provided by our technicians during your appointment.

    • You acknowledge that permanent jewelry is worn during daily physical activities, sports, work, and sleep, and carries an inherent risk of catching, pulling, stretching, or breaking. You voluntarily assume all risks associated with wearing custom-welded chain jewelry.

  • 2.3 Medical Disclaimers & Precautions:

    • Pacemakers & Medical Devices: Clients with pacemakers or sensitive electronic medical devices must inform staff prior to welding.

    • Allergies & Sensitivities: We use high-quality gold-filled, sterling silver, and solid gold materials. It is your responsibility to inform us of any metal allergies or skin sensitivities prior to application. Papillon Jewelry LLC is not liable for allergic reactions, skin discoloration, or sensitivities.

    • Medical Procedures & MRIs: Permanent jewelry can be easily removed by cutting the jump ring with scissors or wire cutters if required for medical procedures, MRIs, or surgeries.

  • 2.4 Minors & Parental Consent: Clients under the age of 18 must be accompanied by a parent or legal guardian who must sign an in-person waiver consenting to the permanent jewelry service.

3. Sales, Repairs, and Re-Welding Policy

  • 3.1 All Sales Are Final: Due to the custom-cut and welded nature of permanent jewelry, all chain and charm sales are strictly final, non-refundable, and non-returnable once welded.

  • 3.2 Chain Care & Repairs:

    • Chains broken at the welded jump ring within 14 days of application will be re-welded free of charge, provided you retain the original chain.

    • Broken chains that occur after 14 days, or chains broken along the link body due to pulling or snagging, may incur a nominal re-welding or repair fee.

    • Papillon Jewelry LLC is not responsible for lost chains, misplaced jewelry, or damage caused by improper care, harsh chemicals, or accidental force.

4. Limitation of Liability & Indemnification

  • 4.1 Limitation of Liability: To the maximum extent permitted by applicable law, Papillon Jewelry LLC, its officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

    • Your use or inability to use our website or booking system;

    • Personal injury, property damage, or chain breakage arising from wearing permanent jewelry or visiting our physical studio space;

    • Any unauthorized access to or use of our servers or stored personal data.

  • 4.2 Indemnification: You agree to defend, indemnify, and hold harmless Papillon Jewelry LLC from any claims, liabilities, damages, expenses, or costs (including legal fees) arising out of your violation of these Terms or misuse of our products and services.

5. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in King County, Washington.

6. Changes to Terms

We reserve the right to revise or update these Terms at any time. Changes will take effect immediately upon posting to our website with an updated "Last updated" date. Continued use of our website or services constitutes acceptance of the modified Terms.
